Dead Batt Terms of Service

These Terms of Service supplement the main document — the Public Offer (תקנון ותנאי שימוש), which is the primary legal document.
1. General Provisions
1.1. These Terms of Service (hereinafter — "Terms") govern the relationship between Dead Batt — D.M Martina ltd. / ד.מ מרטינה בע״מ, registration number 516981685, registered address: Iosef Lishansky 27, Rishon LeTzyon, Israel (hereinafter — "Company", "we", "our") and any individual (hereinafter — "User", "you", "your") using the short-term portable charger (power bank) rental service through automated Dead Batt stations.
1.2. By initiating a rental (tapping your bank card on the station), you confirm that you have fully read and unconditionally accept these Terms. If you do not agree with any provision of these Terms, refrain from using the service.
1.3. The Company reserves the right to modify these Terms at any time without prior notice. The current version is always available at dead-batt.com. Continued use of the service after changes constitutes acceptance of the updated Terms.
1.4. The service is intended for persons aged 18 and older. By using the service, you confirm that you are at least 18 years old.
2. Service Description
2.1. Dead Batt provides a short-term portable charger (power bank) rental service through a network of automated stations located in public places across Israel.
2.2. Power banks are equipped with built-in Lightning, USB-C, and Micro-USB cables and are designed for charging mobile devices.
2.3. A power bank can be picked up at any station and returned to any other station in the network.
2.4. The Company does not guarantee the availability of power banks or free return slots at any specific station at any given time.
2.5. The Company does not guarantee uninterrupted operation of stations and reserves the right to temporarily suspend any station for maintenance or other reasons.
3. Pricing and Payment
3.1. The rental cost is ₪15 (fifteen shekels) for the first hour or any part thereof.
3.2. The maximum rental cost per 24-hour period is ₪30 (thirty shekels).
3.3. A mandatory deposit of ₪70 (seventy shekels) is charged from the bank card upon rental initiation.
3.4. Upon timely return of the power bank, the difference between the deposit and the actual rental cost is refunded to the User's bank card. The refund timeline depends on the issuing bank and may take up to 14 business days.
3.5. If the power bank is not returned within 48 hours of rental initiation, the deposit is retained in full and is non-refundable. The power bank is considered lost.
3.6. The Company reserves the right to change rates and deposit amounts. Current rates are displayed at the station and on the website. Please verify the rate before each rental.
3.7. Initiating a rental (tapping the bank card and receiving the power bank) constitutes unconditional acceptance of the current rates by the User.
3.8. All payments are processed in Israeli Shekels (₪). Currency conversion for foreign bank cards is handled at the issuing bank's rate. The Company is not responsible for any fees charged by the User's bank.
4. User Obligations
4.1. The User agrees to use the power bank solely for its intended purpose — charging mobile devices.
4.2. The User agrees to handle the power bank with care: not to drop, expose to moisture, extreme temperatures, disassemble, or modify it.
4.3. The User agrees to return the power bank to any Dead Batt station within 48 hours of rental initiation.
4.4. Upon return, the User must ensure the power bank is fully inserted into the slot, has not popped back out, and the deposit has been refunded to the card.
4.5. The User bears full responsibility for loss, theft, or intentional damage to the rented power bank. In case of non-return or damage, the deposit is retained in full.
4.6. It is prohibited to transfer the rented power bank to third parties for commercial use.
4.7. It is prohibited to use the power bank to charge devices not designed for charging via Lightning, USB-C, or Micro-USB ports.
5. Limitation of Liability
5.1. Dead Batt power banks and stations are provided "as is." The Company makes no warranties, express or implied, regarding the suitability of the equipment for any particular purpose.
5.2. The Company is not liable for any damage to User devices resulting from power bank use, including but not limited to: battery damage, charging port damage, software damage, data loss.
5.3. The Company is not liable for service interruptions caused by power outages, technical failures, third-party actions, or force majeure events.
5.4. The Company is not liable for indirect damages, lost profits, moral damages, or any other consequential damages related to the use or inability to use the service.
5.5. The Company's maximum aggregate liability to the User on any grounds is limited to the amount actually paid by the User for the specific rental giving rise to the claim.
5.6. The Company is not liable for acts or omissions of third parties on whose premises stations are installed (cafés, restaurants, shopping centers, etc.).
5.7. The Company is not liable for power bank compatibility with any specific model of the User's device.
5.8. The User uses the power bank at their own risk. The Company recommends not leaving devices unattended while charging.
6. Force Majeure
6.1. The Company is released from liability for non-performance or improper performance of obligations under these Terms in the event of force majeure circumstances, including but not limited to: natural disasters, military actions, terrorist acts, strikes, epidemics, pandemics, government decisions, power outages, cyber attacks, payment system failures.
7. Intellectual Property
7.1. All rights to the Dead Batt trademark, logo, station design, software, and website content belong to the Company and are protected by intellectual property law.
7.2. Use of website materials and the Dead Batt brand without written permission from the Company is prohibited.
8. Dispute Resolution
8.1. All disputes arising from or related to these Terms shall be resolved through negotiation.
8.2. If a dispute cannot be resolved through negotiation, it shall be submitted to the court at the Company's registered location in accordance with the laws of the State of Israel.
8.3. These Terms are governed by and construed in accordance with the laws of the State of Israel.
9. Refunds and Claims
9.1. If the User believes the rental cost was charged incorrectly, they may contact support via WhatsApp: 050-505-5455.
9.2. Billing claims are accepted within 30 days of the transaction. Claims submitted after 30 days will not be considered.
9.3. The Company processes claims within 14 business days of receipt.
9.4. Refunds are issued exclusively to the bank card used for the rental.
